Encore Legal Process/Records Retrieval (DWQ)
Records retrieval

Records in hand. Affidavit attached. Deadline met.

Deposition on written questions handled end to end — notice, subpoena, custodian, follow-up, and delivery.

A deposition on written questions is the cleanest way to get a nonparty's records into evidence: the custodian answers written questions under oath and produces the records with a business-records affidavit, so they come in self-authenticated. The mechanics — notice to every party, the subpoena, the service, the chasing — are what eat a paralegal's week. We run them for you, with the same servers and the same live tracking as every other Encore order.

The custodians we subpoena most

+

Medical & billing

Hospitals, clinics, physicians, imaging, therapy, and pharmacy — the core of any injury file, with itemized billing for the damages model.

✓

Employment & payroll

Personnel files, wage records, and attendance for lost-earnings claims, workers' comp, and post-judgment garnishment.

◈

Insurance & claims

Claim files, policies, recorded statements, and adjuster notes from carriers and third-party administrators.

$

Financial & business

Bank and brokerage statements, business records, and vendor files for collections, divorce, and commercial disputes.

How it works

From order to production

01

Order

Case caption, custodian, the records and date range, and any authorization on file. We draft the notice and questions for counsel's signature.

02

Notice

Notice served on every party, then the subpoena and questions served on the custodian once the notice period runs — both with proof of service.

03

Chase

Custodian contacted and tracked to the return date. Objections, fee demands, and "no records" responses flagged to you immediately.

04

Deliver

Records and the sworn business-records affidavit delivered to all parties, ready to file and self-authenticated under Rule of Evidence 902(10).

Why the same vendor for the subpoena and the serve. Records retrieval fails at the hand-offs — a notice served late, a subpoena that never reached the right custodian, a follow-up nobody owned. One order, one job in ServeManager, and one team accountable from notice to production. Custodian, copy, and witness fees pass through at cost.

A note on timing and outcomes. Service-level turnaround targets describe first-attempt goals under normal conditions and are not guarantees of successful service, which depends on the recipient's availability, address accuracy, and access. Encore Legal Process acts as a process server, filing agent, notary, and records-retrieval vendor — not a law firm — and does not provide legal advice. Documents we prepare in support of a filing are prepared at counsel's direction for counsel's review and signature. Substituted, electronic, posted, and publication service require a court order; counsel remains responsible for the motion and for compliance with the applicable rules. Investigations are conducted under Texas Private Investigator License #A29721001.

Fees and sales tax. Court filing fees, Secretary of State fees, custodian and copy fees, and witness fees are passed through at cost. Applicable Texas state and local sales tax is added to taxable services; valid exemption or resale certificates are accepted where applicable. Any tax is reflected on your quote and invoice.
