Questions attorneys ask

Before you send the file

The answers we give on the phone most often, so you can scope the matter without a call.

How long does it take?

It depends on the product. A pre-litigation locate is often back the same business day. Bank and brokerage searches typically run 5–7 business days; real estate, employment, FEIN, and title searches 2–3 business days. A comprehensive search affidavit depends on how many addresses and field attempts the facts call for, and surveillance is scheduled to the window you care about. Every quote carries a delivery date, and rush tiers are available on locates, affidavits, and field work.

What exactly do I receive?

A written deliverable built for the use you told us about. Locates come back as a memo naming the best address, the alternates, and why each is credible. Asset searches identify the institution, account type, and balance range, so your writ or subpoena is aimed at a real target. Affidavits are notarized, executed by the investigator who did the work, and ship with a numbered exhibit package and a chronological search log. Motions and proposed orders, when requested, arrive in editable Word format for counsel's review and signature.

Can your investigator testify?

Yes. The investigator who signed the affidavit or ran the surveillance is available for a contested hearing, a bill of review, or a deposition, and testifies to the work as performed. Testimony and court appearances are billed hourly with a minimum, plus travel, and are scheduled to the court's setting.

Do I need an engagement letter before you start?

Submitting the intake or quote form does not create an engagement. Work begins once we confirm scope, pricing, and permissible purpose and the retainer is placed, or, for account clients, once the matter is billed to the retainer on file. Firms with ongoing or high-volume needs can set up an account so individual matters move without a new retainer each time.

What counts as a permissible purpose?

Our work is performed for attorneys, businesses, and qualified clients with a lawful need: pending or anticipated litigation, judgment enforcement, service of process, and attorney-directed investigation are the usual ones. Results are not consumer reports and cannot be used to decide eligibility for credit, insurance, employment, or housing. Financial searches are run under the Gramm-Leach-Bliley Act with no pretexting, and license-plate and motor-vehicle data under the Driver's Privacy Protection Act. We confirm the purpose at quote, before any work begins.

Do you work outside Texas?

Database work, asset searches, and open-source intelligence are nationwide. Field work outside Texas, including surveillance and in-person address verification, is performed through licensed partner investigators in that state. Our affidavits are written for Texas state courts and for federal courts sitting in Texas, where Rule 4(e)(1) incorporates the state methods of service.

Do you publish prices?

Locates start at $45. Asset searches are priced hit / no-hit, and both fees are set out in your quote so there is no surprise on a dry well. Affidavits, surveillance, background work, and reports are quoted per matter, because the right scope depends on the facts. Applicable Texas sales tax is shown on the quote and invoice.

Can you serve the papers once the court signs?

Yes. Encore is a statewide process serving company first, so the locate, the affidavit, the motion package, and the eventual substituted, posted, or electronic service all run through one vendor and one file, with nothing re-explained between steps.

A note on permissible use. Encore Legal Investigations provides investigative services to attorneys, businesses, and qualified clients with a permissible purpose under applicable law. Our services are not consumer reports and may not be used to determine eligibility for credit, insurance, employment, or housing under the Fair Credit Reporting Act (FCRA). Financial searches are conducted lawfully under the Gramm-Leach-Bliley Act (GLBA) with no pretexting; license-plate-recognition and motor-vehicle data are used only for purposes permitted under the Driver's Privacy Protection Act (DPPA). Asset search results and availability vary by subject and jurisdiction; "hit" and "no-hit" fees are confirmed in each quote. Investigations are conducted under Texas Private Investigator License #A29721001.

A note on affidavits and alternative service. Encore prepares factual investigative affidavits describing the searches performed and the results obtained. Where requested, we also prepare draft motions and proposed orders at the direction of counsel, for counsel's review, revision, and signature. We are not a law firm, do not provide legal advice, do not represent parties, and do not determine whether alternative service is available in your matter. Authorization for substituted, electronic, publication, or posted service rests solely with the court, and rule requirements, local rules, and standing orders vary by court and case type. Rule references on this site are to the Texas Rules of Civil Procedure and are provided for identification only. Counsel remains responsible for the content of any filing and for compliance with the applicable rules.

Sales tax. Applicable Texas state and local sales tax is added to taxable services. Certain out-of-state matters may be exempt, and valid exemption or resale certificates are accepted where applicable. Sales tax, if any, is reflected on your quote and invoice.
